A busy schedule of deadlines regarding the latest measures provided for by the decree launched by the government on 5 January and the measures indicated in the decrees approved in December. Vaccination obligation for those over 50 in effect immediately (with the publication of the decree in the Official Gazette); obligation in the workplace, again for over 50s, from 15 February; from the end of January basic green pass for access to offices, banks and personal services.
The decree passed on January 5 introduces the obligation of vaccination for all Italian and foreign citizens, aged at least 50 , resident in Italy or residing in our country, whether or not they are enrolled in the National Health Service. The obligation will be valid immediately, since the rules that provide for it will enter into force the day after the publication of the decree-law in the Official Gazette, and will remain in force until June 15, 2022 . Vaccination can be omitted or deferred if there are specific clinical conditions that make it “not indicated” and which must be certified by the general practitioner and then evaluated by the territorially competent health company which, in the event that it agrees with the evaluation of the general practitioner, will issue SARS-CoV-2 vaccination exemption certification in compliance with the Ministry of Health’s circulars on the subject. For those who have already been infected and have had Covid, the vaccination is deferred until the first useful date for the vaccination itself.
For all those (workers and non-workers) who do not comply with the vaccination obligation starting from February 1, 2022, a one-off penalty of 100 euros is envisaged . The sanction will be imposed by the Revenue Agency, by crossing the data of the resident population with those resulting from the regional or provincial vaccination registries.
From 10 January the Super Green pass (obtainable with vaccination or recovery), based on the decree in force from 31 December, becomes mandatory, until 31 March, to get on all means of transport, including local and regional ones. The enhanced certification will also be used for outdoor catering services, for access to hotels; for fairs and congresses and to use the ski resorts.
From January 20th to March 31st 2022 (current term of the state of emergency) the basic green pass obligation is triggered for customers of hairdressers, barbers, beauty centers.
From 1 February until 31 March 2022, the basic Green pass (issued with an antigenic pad valid for 48 hours or a molecular pad valid for 72 hours) is extended to customers of public offices, postal, banking and financial services, commercial activities. Shops that sell food, pharmacies and activities aimed at the “essential and primary needs of the person” are excluded. For people who access without a Green pass to the services and activities in which it is mandatory to have it, there is a penalty from 400 to 1,000 euros. The same sanction is applied to the person required to check possession of the green document if he fails to check.
From 15 February for public and private workers aged 50, the reinforced green pass will be mandatory for access to workplaces until 15 June 2022. A fine ranging from 600 to 1,500 euros is envisaged.in the case of access to the workplace in violation of the obligation. As is already the case for workers without a basic Green pass, workers over the age of fifty who from February 15, 2022 will not have the reinforced pass at the time of accessing the workplace will be considered unjustified absent, without disciplinary consequences and with the right to retention. of the employment relationship but without the right to remuneration or other remuneration or emolument. Anyone who is not yet vaccinated will have to take the first dose of the vaccine by January 31 to get an enhanced Green pass valid from February 15.
For those who are vaccinated (over 50) and are caught in the workplace without a reinforced green pass,the sanction is doubled in case of repeated violation . And what is foreseen by the decree on anti-covid measures approved last Thursday in the CDM and which will soon be stamped.
