In recent years, buying appliances has become easier for everyone: there are offers of all kinds, installments, discounts, and so anyone can buy new appliances for their home. Problems arise when the product breaks down and therefore you have to enforce the guarantee.
Unfortunately in this case, when you bring the product back to the shop or call the technician, you will hear an ambiguous answer too many times. Answers like “I don’t think you can pass the warranty” or “Buy a new one first” are certainly not that rare. The consumer therefore finds himself in the position of having to enforce his right to the guarantee of household appliances if the breakage occurs within three years.
But how does this right
How do you get it right
To understand more, we turned to the experts of adriaticaelettrodomestici.it, one of the most well-known appliance sales companies in central Italy, who confirm that the shops often try to be clever with their customers by pushing them to give up the repair and discouraging the use of the guarantee.
The law is clear: there is a legal guarantee of conformity which lasts for two years. Since the sale of household appliances is a real contract, consequently the seller bears the responsibility of guaranteeing the customer the sale of a product that is suitable for use and compliant with the contract. It is up to the consumer to report, within two months of discovery, any lack of conformity of the product that occurs within two years of sale; and this responsibility for the defect consequently rests on the seller himself. Therefore the customer must pay nothing for defects (of conformity, of course, and not caused by his own responsibility or neglect) that are made good.
The legal guarantee of conformity is mandatory and therefore it cannot be waived; just keep the sales receipt in a safe place to prove that you are still entitled, within two years from the sale, to free repair or replacement of the goods. If the repair or replacement is excessively expensive or impossible, you are entitled to a reduction in the price and termination of the contract.
The only problem therefore lies in the fact that the customer is not adequately informed of his rights and consequently often does not know how to enforce them.
Therefore, every consumer must be aware of the rights that they are entitled to: of course, one must know how to distinguish between conformity defects (which are therefore due to the good as such) and those caused by neglect or wrong use of the product.
Furthermore, additional paid services are often sold that extend the legal guarantee: but beware, the 2-year legal guarantee is due and free by law and can never be paid by the customer.
Therefore, if you believe that it is necessary to stipulate an additional service that extends the warranty beyond two years for a fee, you can do it; but remember that any structural defect must be reported within two months and in the first two years of purchase it entitles you to the free warranty.
